Please read these terms of use (the “Terms”) carefully before using this site. 

The Terms (together with the documents referred to in them) set out the terms and conditions on which you may make use of any of our website at www.careers.southeasternrailway.co.uk (the ”Site”) whether as a guest or a registered user. Use of our Site includes accessing, browsing, or registering to use our Site. These Terms apply between SE Trains Limited (SET)  (“we”, “us” or “our”) and you, the person accessing or using the Site (“you” or “your”). For the avoidance of doubt, the information contained on this Site concerns services and information in relation to SE Trains Limited (SET)  only.

Please read these Terms carefully before you start to use our Site, as these will apply to your use of our Site. We recommend that you print a copy of the Terms for your future reference.

By using our Site, you confirm that you accept these Terms and that you agree to comply with them.

  4. Prohibited Uses
    1. You may only use our Site for lawful purposes. You may not use our Site:
      1. in any way that breaches any applicable local, national or international law or regulation;

By breaching this provision, you may be committing a criminal offence under the Computer Misuse Act 1990; or

  1. Accessing our Site
    1. Our Site is made available free of charge.  We do not guarantee that our Site, or any content on it, will be free from errors or omissions.
    2. We do not guarantee that our Site, or any content on it, will always be available or be uninterrupted. Access to our Site is permitted on a temporary basis. We may suspend, withdraw, discontinue or change all or any part of our Site without notice. We will not be liable to you if for any reason our Site is unavailable at any time or for any period.

  3. Your Account and Password
    1. You are not required to register your details with us in order to browse the vast majority of our Site. If you visit an area or page which requires a login you will be given information on how to register and access content, unless this is restricted content. 
    2. Before registering your details please ensure you have read these Terms and all Other Applicable Terms available on the Site regarding data protection and policies. Any registration details should be per user and not shared with multiple users or parties.
    3. If you choose, or you are provided with, a user identification code, password or any other piece of information as part of our security procedures, you must treat such information as confidential. You must not disclose it to any third party. We have the right to disable any user identification code or password or we may suspend or terminate your account at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these Terms.

  4. Intellectual Property Rights

We are the owner or the licensee of all intellectual property rights on our Site, and in the material published on it.  Those works are protected by copyright laws and treaties around the world and/or other forms of applicable intellectual property rights protection. We and our licensors reserve all our intellectual property rights (including, but not limited to, all copyright, trade marks, domain names, design rights, database rights, patents and all other intellectual property rights of any kind) whether registered or unregistered anywhere in the world. This means, for example, that we remain owners of them and are free to use them as we see fit. You may print off one copy, and may download extracts, of any page(s) from our Site for your personal use and you may draw the attention of others within your organisation to content posted on our Site.
    2. Nothing in these Terms grants you any legal rights in the Site or the content on it other than as necessary for you to access it. You agree not to adjust, try to circumvent or delete any notices contained on the Site or the Site’s content (including any intellectual property notices) and in particular, in any digital rights or other security technology embedded or contained within the Site or its content.

    1. Whenever you make use of a feature that allows you to upload content to our Site, or to make contact with other users of our Site, you must comply with the Terms.
    2. You warrant that any such contribution does comply with those standards, and you will be liable to us and indemnify us for any breach of that warranty. This means you will be responsible for any loss or damage we suffer as a result of your breach of warranty.
    3. We have the right to remove any content or material which you upload to our Site if, in our opinion, your post does not comply with these Terms or if it is otherwise immoral, defamatory, libellous, obscene or otherwise offensive.
    4. You are solely responsible for securing and backing up your content and we will not be responsible for any loss or damage to such content as a result of you using and uploading to our Site.

    1. You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it.
    2. You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists. You must not scrape data from this Site for any reason.
    3. You must not establish a link to our Site in any website that is not owned by you.
    4. Our Site must not be framed on any other site, nor may you create a link to any part of our Site other than the home page.

  4. Applicable Law
    1. If you are a consumer, please note that these Terms, and our relationship governing your use of this Site, are governed by English law. You and we both agree to that the courts of England and Wales will have non-exclusive jurisdiction. However, if you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are resident of Scotland, you may also bring proceedings in Scotland.
    2. If you are a business, these terms, its subject matter and its formation (and any non-contractual disputes or claims) are governed by English law. We both agree to the exclusive jurisdiction of the courts of England and Wales.
  5. Advertisements
    1. The Site may contain material, including advertising and sponsorship, which originates from third parties. We exclude, to the fullest extent permitted by law, all liability for any illegality arising from or error, omission or inaccuracy of such material or failure to comply with any relevant law or regulation. 
    2. It is the responsibility of such third parties to ensure that such material complies with all relevant laws and regulations.

    2. To the fullest extent permitted by law, we exclude all conditions, warranties, representations or other terms which may apply to our Site or any content on it, whether express or implied.
    3. We will not be liable to any user for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:
      1. use of, or inability to use, our Site; 
      2. use of or reliance on any content displayed on our Site; or
      3. use of the Site by you.
    4. We will not be liable for any indirect or consequential loss or any loss or damage caused by a virus, distributed denial-of-service attack, or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our Site or to your downloading of any content on it, or on any website linked to it.
    5. We assume no responsibility for the content of websites linked on our Site. We will not be liable for any loss or damage that may arise from your use of them.

We are not liable to you if we fail to comply with these Terms because of circumstances beyond our reasonable control, including, but not limited to, strikes, lock-outs or other industrial disputes; breakdown of systems or network access; flood, fire, explosion or accident; or epidemics or pandemics.

You hereby agree indemnify us against any claim brought by a third party resulting from use by you of the Site in respect of all losses, costs, actions, proceedings, claims, damages, expenses (including reasonable legal costs and expenses), or liabilities, whatsoever suffered or incurred by  us in consequence of your breach or non-observance of these Terms and/or use of this Site.
    8. Other than in respect of any liability which may not be limited or excluded under applicable law, our liability to you shall be limited to £50 in aggregate for all liability arising from your use of the Site.
  8. Unauthorised Access by Third Parties

It is possible that third parties such as 'hackers' or 'crackers' may access the Site and alter its contents. We will not be liable for any damages or loss arising out of or in connection with such unauthorised access. We exclude all liability in respect of any unauthorised access to the fullest extent permitted by law.

  1. Privacy

We take the issue of data protection very seriously. We may collect information about you while you browse the Site if you are a registered user of the Site. Our policy is set out in our Privacy policy (https://careers.southeasternrailway.co.uk/members/modules/hf/privacy.php) which explains what personal information we collect from you, how and why we collect, store, use and share such information, your rights in relation to your personal information and how to contact us and supervisory authorities in the event you have a query or complaint about the use of your personal information . So that we may comply with our obligations under data protection legislation, you are required to read and agree to the Privacy Policy before providing us with any information about yourself. Failure to do so is a breach of these Terms.

  1. Miscellaneous
    1. If at any time any part of these Terms become invalid, illegal or unenforceable in any respect, that invalid, illegal or unenforceable part shall be severed from the remainder of these Terms and the validity, legality and enforceability of the remainder of these Terms shall not be affected or impaired in any way.
    2. Further, the invalid, illegal or unenforceable part will be deemed superseded by a valid, legal or enforceable part that most closely satisfies the intention of the original part. The validity, legality and enforceability of the remainder of these Terms shall not be affected or impaired in any way. 
  2. General
    1. You may not assign, sub-license or otherwise transfer any of your rights under these Terms.
    2. These Terms cannot be varied except in writing by us. Nothing said by our employees or agents will be capable of varying these Terms.
    3. Failure by either party to exercise any right or remedy under these Terms does not constitute a waiver of that right or remedy. Headings in these Terms are for convenience only and will have no legal meaning or effect.
    4. The parties do not intend any of these clauses to be enforceable pursuant to the Contracts (Rights of Third Parties) Act 1999.
